The idea of a geographic restriction is that it is in the best interest of a child to maintain relationships with family, school(s) and friends. The geographic restriction does not mean that either party can not TRAVEL with the child outside the restricted area. A party wishing to lift a geographic restriction has the burden to show the court WHY it is in the best interest of the child that a move should happen. Geographic restriction cases are not to be taken lightly, and normally require the hiring of a skilled family attorney as well as a professional expert. In highly contested cases, we recommend you attempt to go to mediation and see if any terms can be settled to allow for the geographic restriction to be lifted BEFORE the costly process of litigation.
